A registered marriage certificate is required for: spouse visa applications (UK, USA, Canada, Australia, UAE); joint property ownership; insurance nominations; and a range of government benefits. Without it, proving the marriage to foreign immigration authorities can be extremely difficult.
The Special Marriage Act, 1954 allows any two people to register their marriage regardless of religion. The application is made to the Marriage Officer (typically the Sub-Divisional Officer) with 30 days' notice. Both parties must be present. After the notice period, if no objection is received, the marriage is solemnised and registered.
If you were married in a religious ceremony but never registered the marriage, you can register it retrospectively. The process requires: proof of the marriage (photographs, invitation cards, religious ceremony records); identity documents of both parties; two witnesses who were present at the marriage; and an affidavit confirming the marriage details.
